Under fairtax.org‘s Frequently Asked Questions - Answers we find:
What about the flat tax? Would it be better and easier to pass?Under a flat tax, individuals would still file an income tax return each year similar to today’s 1040 EZ. While this is a simple postcard, the record keeping required to fill in the blanks is still long and burdensome. Under the FairTax, individuals never file a tax return again, ever! Under the flat tax, the payroll tax would be retained and income tax withholding would still be with us. Under the FairTax, the payroll tax, which is a larger and more regressive tax burden for most Americans than is the income tax, is repealed. Under the FairTax, what you earn is what you keep. No more withholding taxes; no more income tax.
Did you see that? “Under the FairTax, individuals never file a tax return again, ever!”
The truth is, any individual who may utilize their talents [carpentry, plumbing, electrical, auto repair, ground maintenance, painting, baby sitting, manicures, hair dresser, etc.] and sell these services to another individual for fair market value compensation, is subject to the iron fist of government under H.R. 25. Here are some applicable citations from the text of the proposed legislation:
`SEC. 103. RULES RELATING TO COLLECTION AND REMITTANCE OF TAX.
`(a) LIABILITY FOR COLLECTION AND REMITTANCE OF THE TAX- Except as provided otherwise by this section, any tax imposed by this subtitle shall be collected and remitted by the seller of taxable property or services (including financial intermediation services).
`(f) BARTER TRANSACTIONS- If gross payment for taxable property or services is made in other than money, then the person responsible for collecting and remitting the tax shall remit the tax to the sales tax administering authority in money as if gross payment had been made in money at the tax inclusive fair market value of the taxable property or services purchased.SEC. 502. REGISTRATION.
`(a) IN GENERAL- Any person liable to collect and remit taxes pursuant to section 103(a) who is engaged in a trade or business shall register as a seller with the sales tax administering authority administering the taxes imposed by this subtitle.
`SEC. 505. PENALTIES.
`(a) FAILURE TO REGISTER- Each person who is required to register pursuant to section 502 but fails to do so prior to notification by the sales tax administering authority shall be liable for a penalty of $500.
SEC. 510. TAX TO BE SEPARATELY STATED AND CHARGED.
`(a) In General- For each purchase of taxable property or services for which a tax is imposed by section 101, the seller shall charge the tax imposed by section 101 separately from the purchase. For purchase of taxable property or services for which a tax is imposed by section 101, the seller shall provide to the purchaser a receipt for each transaction that includes--
I just wonder if John Linder plans to fine the 15 year girl who baby sits for a neighbor and refuses to collect and hand over to Congress H.R.25's socialistic tax on the sale of the property she has in her labor?
In any event here is the path which John Linder has created which leads to the iron fist of the federal government’s total power grab under H.R. 25:
SEC. 407. JURISDICTION.
`(a) STATE JURISDICTION- A sales tax administering authority shall have jurisdiction over any gross payments made which have a destination (as determined in accordance with section 405) within the State of said sales tax administering authority. This grant of jurisdiction is not exclusive of any other jurisdiction that such sales tax administering authority may have.
(b) FEDERAL JURISDICTION- The grant of jurisdiction in subsection (a) shall not be in derogation of Federal jurisdiction over the same matter. The Federal Government shall have the right to exercise preemptive jurisdiction over matters relating to the taxes imposed by this subtitle.
Now, I don’t know what fairtax.org means when they suggest individuals will no longer have to keep records under the alleged fair tax, but, Joe Sixpack, and individual who does handyman work in his neighborhood including lawn maintenance, and Billy the plumber, and individual who does side jobs in his neighborhood when not working for his boss, will both have to keep any records and reports which Congress may dream up and send the tax on such services to the federal government. And, they would be subject to audits of such records and be under a penalty of perjury when filing such tax return records!
Come now Fairtax org., why do you keep misrepresenting the truth and make things up?
And tell us fairtax org, aside from the big lie mentioned above, why would any freedom loving person want to put every American family on the public dole with H.R.25’s family consumption allowance, when our founding father‘s method of taxing consumption would eliminate the need of putting every American Family on the public dole? Why do the ringleaders of H.R. 25 want to make the majority of American Voters dependent upon the Washington Establishment for a monthly subsistence check? Could it be because of what was said in the Federalist Papers ___ that control over a man’s subsistence amount to a power over his will?Regards,
